Course Description

Attorneys Bob Goldstucker and Laura Eschleman will address risk management issues in 2020 and the ways in which you can avoid a claim or a lawsuit, including documentation, informed consent, whether you are obligated to take on certain patients, and how to terminate patient relationships.

Learning Objectives:

 

  • Discuss why proper documentation is so important and what will surprise you about your EMRs
  • Review key components of documentation in a medical record
  • Demonstrate proper informed consent documentation and identify challenges with the informed consent conversation
  • Discuss whether a podiatrist is obligated to see a patient upon discharge from the hospital or ER when the patient is uninsured or has unaccepted insurance
  • Discuss protocol to follow to terminate a relationship with a patient

Laura D. Eschleman, Esq.

Laura D. Eschleman is a medical malpractice partner at Nall & Miller, LLP in Atlanta, Georgia. She is licensed in Georgia, Alabama, and Missouri and has worked on malpractice cases in 29 different states. Of those cases that went to trial, she has tried and won multiple defense verdicts for podiatrists in several states. Additionally, she represents podiatrists in administrative actions in front of their state podiatric licensing boards and in audits conducted by Medicare, Medicaid, quality improvement organizations, and private health insurance companies.

 

Bob Goldstucker, Esq.

Bob Goldstucker has been Managing Partner at Nall & Miller for the past 14 years. Bob specializes in the defense of medical malpractice claims, legal malpractice claims, constitutional law claims, civil rights claims, other professional liability, insurance agent errors and omissions, tort claims, insurance coverage matters, professional licensing board proceedings, antitrust matters, and securities. He has been a member of the Georgia Bar since 1977 and is also licensed to practice in Iowa, Washington, and Nevada. In nearly 40 years of practice, Bob has litigated or mediated in 45 states, serving as lead counsel in more than 125 jury trials in state and federal courts throughout the United States. Bob has represented his clients in more than 500 mediations and arbitrations and is often called upon to handle negotiations in cases where he is not defense counsel because of his skill and acumen at negotiation.
